These Terms of Service (“Terms”) govern your access to and use of UpChamp’s websites, mobile applications, smart football product, and related services (collectively, the “Services”).
If you do not agree to these Terms, do not use the Services.
1. Who We Are
“UpChamp,” “we,” “us,” or “our” refers to UpChamp and its affiliated entities operating in the UK, Europe (EEA), and UAE.

2. Eligibility and Accounts
2.1 Age
- The Services are intended for users 18+.
- Users under 14 may use the app only with parent/guardian consent and supervision, through a parent-managed account.
2.2 Account Responsibility
You are responsible for:
- Keeping your password secure
- All activity under your account
- Ensuring the information you provide is accurate
We may suspend or terminate accounts for violations of these Terms.
3. The Product and App
3.1 Smart Football + App
UpChamp sells a smart football and provides a training app to help track football drills and performance metrics.
3.2 Camera-Based Tracking
Our app may use your device camera to track training and performance. Training video is processed locally on your device and is not uploaded or stored as video by UpChamp (see Privacy Policy for details).
3.3 Service Changes
We may update or modify features to improve performance, fix bugs, or maintain security. We do not guarantee that any specific feature will always remain available.
4. Purchases, Pricing, and Payments
4.1 Orders
When you place an order, you agree that:
- You are authorised to use the payment method
- You will provide correct shipping and billing details
4.2 Payment Processing
Payments may be processed by third-party payment providers. We do not store full payment card details.
4.3 Pricing
Prices, promotions, and availability can change at any time. If a pricing error occurs, we may cancel or correct the order as permitted by law.
5. Shipping, Returns, and Refunds
Your return/refund rights depend on where you live and the purchase type.
5.1 UK/EEA Consumer Rights
Nothing in these Terms limits mandatory consumer rights under applicable law.
For physical goods, you may have rights relating to:
- Faulty goods
- Delivery issues
- Statutory cancellation periods (where applicable)
5.2 Our Returns Policy
Your purchases may also be subject to our Returns & Refund Policy (posted on our website), which forms part of these Terms.
6. Acceptable Use
You agree not to:

- Upload harmful code or attempt unauthorised access

- Use the Services for illegal purposes

- You confirm you have rights to share it
- You grant UpChamp a worldwide, non-exclusive, royalty-free licence to use it to operate, improve, and market the Services (unless prohibited by law)
We may moderate or remove content that violates rules or is inappropriate
8. Intellectual Property
- All software, branding, designs, training content, and materials are owned by UpChamp or its licensors.
- You receive a limited, personal, non-transferable licence to use the Services as intended.
- You may not copy, distribute, modify, or create derivative works without written permission.
9. Health and Safety Disclaimer
The Services are for training and fitness support and do not replace professional coaching or medical advice.
You are responsible for:
- Training safely
- Using appropriate footwear/surface/environment
- Supervising minors
Stop training if you feel pain, dizziness, or risk of injury.
10. Disclaimers
To the maximum extent permitted by applicable law:
- Services are provided “as is” and “as available”
- We do not guarantee uninterrupted or error-free operation
- Performance metrics may be estimates and can be affected by lighting, camera angle, device performance, and environment
11. Limitation of Liability
Nothing in these Terms excludes liability where unlawful (e.g., death/personal injury caused by negligence, fraud).
Subject to mandatory consumer laws, UpChamp will not be liable for:
- Indirect or consequential losses
- Loss of profits, revenue, goodwill, or data
- Issues caused by your device, network, or third-party services
Where liability cannot be excluded, it will be limited to the amount you paid for the relevant product or service (or the minimum required by law), depending on your jurisdiction.
12. Termination
You may stop using the Services at any time and may delete your account via the Delete My Account page.
We may suspend/terminate your access if you:
- Breach these Terms
- Create security/legal risk
- Misuse the Services
13. Privacy
Your use is also governed by our Privacy Policy, which explains how we collect and use personal data.
14. Governing Law and Disputes
Because you operate across regions, we apply this structure:
14.1 UK
If you are in the UK, these Terms are governed by the laws of England and Wales, and courts of England and Wales will have jurisdiction, subject to mandatory consumer protections.
14.2 EEA
If you are in the EEA, you may also benefit from mandatory protections in your country of residence.
14.3 UAE
If you are in the UAE, disputes may be governed by applicable UAE laws and handled by competent UAE courts, subject to local consumer rules.

We may update these Terms from time to time. If changes are material, we will post updated Terms with a new “Last updated” date and may notify you through the app or email.
